Registrations in the Swiss National Database
If you place products on the Swiss market, the importer may require the product to be registered in the national database, the RPC. How does this process work, what does it cost, and who is obligated to carry out this registration? We will briefly explain this below.
Which products need to be registered?
A product must be registered no later than 3 months after being placed on the market. Both single substances and mixtures must be registered. There is no minimum quantity threshold for when a substance or mixture must be registered. This does not apply to intermediates and mixtures intended solely for professional use. These products only need to be registered from 100 kg per year.
Registration must occur if one of the following conditions is met:
- Hazardous substances and mixtures;
- Substances listed in Annex 3 of ChemO (SVHC);
- Non-hazardous mixtures with one of the following ingredients:
- An ingredient hazardous to health or the environment (H3xx or H4xx) in a concentration of ≥ 1 w/w% (non-gas mixture) or ≥ 0.2 v/v% (gas mixture);
- An ingredient with the following classifications present at ≥ 0.1 w/w%:
- Carcinogen Category 2 (H351);
- Reproductive toxin Categories 1A, 1B, and 2 (H360 & H361);
- Skin allergen Category 1 (H317);
- Respiratory allergen Category 1 (H334);
- Substance affecting or via lactation (H362);
- PBT or vPvB substance (EUH440 & EUH441);
- An ingredient present at ≥ 0.1 w/w% listed in Annex 3 of ChemO (SVHC);
- An ingredient with a workplace limit according to Directives 2000/39/EC, 2006/15/EC, 2009/161/EU, (EU) 2017/164, or (EU) 2019/1831 (IOELV).
Who must register the products?
The importer in Switzerland, as the natural or legal person responsible for placing the product on the market, is responsible for registration with the RPC. According to legal definitions, this importer is considered the producer.
It is possible to be added as a 'sub-user' to the account of a Swiss importer. This way, a foreign company can submit a composition in the RPC portal without the Swiss importer being able to see the composition.
Additional costs for product registration
As far as we know, there are no additional costs for non-Swiss companies to register products.
